This just in … a news item in today’s The New Straits Times. I’ll be reproducing it verbatim and won’t be making any comments on it as the item is self-explanatory:
KUALA LUMPUR: Two rival companies which specialise in the writing of wills and trusts have taken their legal battle further.
Rockwills Corporation Sdn Bhd has initiated contempt proceedings in the High Court against OSK Trustees Bhd and one of its directors, Ong Eu Jin.
Rockwills is claiming that OSK and Ong had breached a court order which allowed it to search and seize evidence on OSK’s premises and restrain OSK and its agents from using presentation slides to promote their services.
Rockwills had earlier filed a copyright infringement suit, claiming that OSK had copied its presentation slides.
On Jan 5, Rockwills had obtained a High Court ex-parte order to search OSK’s premises and stop it from using the slides or reproducing them. On Jan 23, the order was further extended until the the court heard both parties.
Rockwills, in its March 8 application to commit OSK and Ong for contempt, said OSK and Ong had not taken steps to notify its agents to stop using the slides.
The plaintiff’s counsel, Malik Imtiaz Sarwar, who appeared with M. Thomas Philip, told judge Datuk Siti Mariah Ahmad in chambers yesterday that OSK and Ong had not made sure that the materials were no longer used.
He said OSK and Ong had breached the court order by insisting that they had the copyright for the slides.
Datuk D.P. Naban, who represented OSK and Ong, said the order was ambiguous and there was no evidence to show that they had violated the order.
Siti Mariah will deliver her ruling on April 20.
