Rockwills, OSK settlement?

I’ve been hearing on the ground that the court cases between Rockwills Trustee Berhad and OSK Trustee Berhad are heading for settlement soon. An out-of-court settlement perhaps, with both sides dropping all claims?

If this is true, this piece of good news cannot be more welcomed because the sooner this matter is resolved, the earlier both parties can rechannel their resources into their own more productive channels.

From what I understand, the allegation was that one had copied their training and presentation materials from the other, and vice versa. I cannot comment on this since I’ve had no opportunity to make comparisons but I’ve always wondered whether at the end of the day, would it be possible for the facts in one set of training notes to be materially different from the facts in another set, especially if they are touching on the same subject? Indeed, I shouldn’t be surprised if the texts are worded similar too. I mean, how different can they be when you are writing or talking about the same narrow topic?

What happened was that at the beginning of 2006, OSK Trustee took an injunction on Rockwills Trustee and followed up with a raid on the Rockwills premises. Earlier this year, Rockwills Trustee took the same path to search the OSK Trustee premises in return. Tit-for-tat? Maybe. Or perhaps there was a real justification and deeper business issue.

Nevertheless, if the two trust corporations are now willing to reach a settlement, it means that good sense has prevailed finally. But I can tell you, it must have been a trying time at Rockwills Trustee to defend themselves against the charges in the first place.
